Understanding the Local Plan Process

The Local Plan is prepared in stages, and each stage gives you an opportunity to get involved. Below is a simple guide to how the process works and what each stage means.

What is Regulation 18?

Regulation 18 is a relatively early stage in preparing the Local Plan. At this point, we publish draft proposals and invite feedback from residents, businesses and stakeholders before moving to the next stage.

What has happened to the comments the Council received in response to the last Regulation 18 consultation?

In April 2024 we launched our first Regulation 18 consultation on the draft Local Plan, which was focused on topic policies rather than sites for development. We have published an Interim Consultation Statement which summarises the main issues and comments raised during that consultation, and our next steps in addressing them.

What happens after this consultation?

All comments received during this Regulation 18 consultation will be reviewed and considered. Together with the comments received to the first consultation, they will help shape the next version of the Local Plan, which will be published for formal representations at the Regulation 19 stage.

What is Regulation 19?

Regulation 19 is the stage where the revised Local Plan is published for comment before it is submitted to the Planning Inspectorate for independent examination.

At this stage, representations must relate to the legal and soundness tests that the Inspector will consider.

When will the plan be adopted?

After Regulation 19, the plan will be submitted for independent examination.

If the Inspector finds the plan sound (with or without modifications), it can then be adopted. Once adopted, the Local Plan will form the framework for planning decisions in Rother.

Timeline

  • Current Stage: Regulation 18 Consultation
  • Next: Regulation 19 (draft for formal representations in late summer 2026)
  • Submission: December 2026
  • Adoption: Following examination and approval

Why does this process matter?

The Local Plan shapes where new homes, jobs, community facilities and infrastructure will go for the next 17 years.
