Following the withdrawal of the plan from examination (please see below for explanation), Rye Town Council has produced a Modification Statement in the prescribed format and is managing a new public consultation (Regulation 14) on the Neighbourhood Plan.

April – May 2025Examination (Regulation 17)

The examination process (Regulation 17) began in mid-April, whereby the examiner posed preliminary questions to Rother District Council (RDC), relating to whether a “Modification Statement” had been provided in the format set out in legislation. A Modification Statement sets out all the changes proposed to be made to a Neighbourhood Plan through a Plan Review. Considering legal advice, RDC determined that unfortunately, the Modification Statement had not been provided in the prescribed format. As such, Rye Town Council took to the decision to withdraw the plan from examination. The preliminary questions and RDC response can be viewed below.

To proceed, it is now necessary for the Neighbourhood Plan, together with a Modification Statement, to be subject to a new round of public consultations.

The failure to provide the required statement of modification by Rye was overlooked by RDC during the earlier public consultations; this was due to an information gap, now rectified.

Referendum on the Adoption of the Rye Neighbourhood Plan

Residents of Rye Parish voted 677 to 109 in favour of adopting the modified Plan.

17 May 2019

Decision to go to Referendum (Regulation 18, 2)

Rother District Council decided to take the Rye Neighbourhood Plan to Referendum.

Publication of the Examiners Report (Regulation 18, 1)

The Examiner produced the Report in which modifications were recommended that would enable the Plan to proceed to Referendum.

    Rother District Council confirmed that the marked area shown on the submitted map (being that of Rye Parish) was formally designated as a Neighbourhood Area.

    Application for the designation of Rye Parish as a Neighbourhood Area (Regulation 5)

    Rye Town Council submitted to Rother District Council an application for the designation of Rye Parish as a Neighbourhood Area.

    This application included the following:

    • A map which identifies the area to which the area application relates
       
    • A statement explaining why the area is considered appropriate to be designated as a Neighbourhood Plan Area
       
    • A statement setting out why Rye Town Council is a relevant body for the purposes of section 61G of the Town and Country Planning Act 1990
