Lawful Development Certificate for a Proposed Use or Development

If you require a formal decision as to whether planning permission is required for your proposal you will need to submit an application for a Certificate of Lawful Development – Proposed use.

Please note however, if this Certificate determines that planning permission is required you would then need to submit the planning application together with a further fee.

You can submit your application electronically via the Planning Portal or alternatively download the application form, guidance notes and Schedule of planning fees.

Please note: It is not possible for the local planning authority to seek modifications to a proposal submitted to us under this procedure.  Instead, if the proposal is not lawful, the authority must refuse the application and suggest that the applicant amends the proposed development in a fresh application. Applicants should ensure that the proposal is described in detail, with precision and relate to all permitted development criteria where applicable.

For a formal decision as to whether listed building consent is required for your proposal you will need to submit an application for a Certificate of Lawfulness of Proposed Works to a listed building

There is no fee for an application for a certificate of lawfulness of proposed works to a listed building.
