Premises where contamination may have taken place, such as oil leaks and buried waste, due to past uses may be deemed contaminated land under Part 2A of the Environmental Protection Act 1990.

We are consulted on all planning applications where there is the possibility of land contamination being present. We will then work with the planning department and the developer to ensure any site investigation and/or remediation is carried out properly to make the development safe for its new use.

At present, there are no formally determined contaminated land sites in the Rother District and so there are no entries on the public register.

Queries relating to the historic use of land can be submitted as an Environmental Information Request (EIR).

Some Environmental Information Requests may require an additional fee due to the officer checking and collating of contaminated land information.
