The Council is not formally evicting any of the tenants; the current tenants occupy under fixed term leases that are excluded from the security of tenure provisions of the Landlord and Tenant Act 1954 and these leases are coming to an end. The majority of the leases ended last year and were extended for another year until the council was able to proceed with the repair works. All tenants were aware of the terms of their leases and for over one year we have made it clear that they would all come to an end this September to enable the works and that they would need to vacate the premises in accordance with the terms of the leases
As a local authority we must conduct a fair process for all prospective tenants rather than offering guarantees to any specific business. Once the work is complete, we will openly market the available units and any businesses will be welcome to apply. While existing tenants will not be given first refusal, we will consider the good relationships and excellent track record of the existing tenants when new lease applications for the refurbished Colonnade units are assessed.
As a local authority we have a responsibility to demonstrate best value, meaning we must conduct a fair process for all prospective tenants rather than offering guarantees to any specific business. As a local authority it is essential we try to maximise our income but we do also consider and measure social and community value. While the current tenants are valued and well-regarded locally, they are commercial enterprises, not community-run or charitable organisations.
We take social and community value into account when letting our properties, but this must show a tangible benefit to the wider public beyond simply being a popular local business. Where a tenant or group can demonstrate this higher level of community or social value, we may agree a rent that reflects that benefit. Otherwise, rents will be set in line with the open market, which is likely to be significantly higher than current levels.
The Colonnade, a Grade II listed building in Bexhill was built in 1911 to commemorate the coronation of King George V. Essential repairs are required to ensure the future of the historic building. Works planned are aimed at resolving persistent water ingress issues, refurbishing water-damaged areas, and delivering comprehensive redecoration and performance improvements. Toilet facilities will also be installed for use by future tenants.
We have provided support to the traders affected which has included working with local agents and advising our tenants to register directly with them, offering to act as potential lease guarantor for short-term arrangements if needed. Reflecting the diminishing lease term and condition of the building we have also reduced the rent where needed. In addition we have sourced advice for one of the tenants so that they can move some of their business on-line.
Final negotiations are in progress and works will commence on the 1st October.
We want the Colonnade to be at the heart of the beachside community, contributing to the visitor experience and playing a role in the development of the regeneration of Bexhill seafront.
Our preference is to continue to support independent, local businesses trading from the kiosks at the Colonnade within the rules that apply to public bodies acting as landlords.
